LSN Capital Pty Ltd (LSN Capital) collects personal information from time to time to conduct its business and comply with a range of legislative requirements.

By providing us with your personal information, you consent to us collecting, using, disclosing and otherwise handling your personal information in accordance with this Privacy Policy as updated from time to time.

Purpose of this Policy

This policy explains how LSN Capital (weus) aim to protect your privacy.

The kinds of personal information we collect and hold may include your name, home or work address, work email address, your financial interests and financial position, telephone/mobile number, and signature. We do not collect sensitive personal information (such as racial or ethnic origin, political opinions or religious beliefs or affiliations), unless required by applicable laws or rules 

If you provide unsolicited personal information that we have not requested, we will, unless otherwise required or permitted by law, delete or destroy it as soon as possible after receiving it. If unsolicited personal information is required or permitted by law, we will ensure compliance with the Australian Privacy Principles.

You are not obliged to give us your personal information however if you decide not to give us the personal information we request, we may not be able to provide our services to you. There may be specific instances where we are prevented by law from dealing with you unless we identify you.

2. Collection of Personal Information

2.1 How and when we collect personal information

(a) when you provide it to us

When it is reasonable and practical, we collect information about you directly from you.

(b) when someone else provides it to us on your behalf

In some cases, we may collect personal information from third parties such as public sources, related companies, brokers, referrers, agents, your adviser(s) and our service providers.

2.2 Purposes for which we collect, use, and disclose personal information

The purposes for which we collect, use, and disclose personal information include:

  • Providing you with a financial product or service,

  • considering approaches you make to us,

  • maintaining your contact details,

  • assessing or responding to claims, complaints or conduct, or co-operate with investigations when required,

  • to obtain professional services as required including legal, human resources, industrial relations, accounting and insurance services,

  • for purposes directly related to all of the above,

  • otherwise as permitted or required by law such as taxation and Anti-Money Laundering and Counter-Terrorism Financing, or

  • otherwise with your consent.

We will not adopt, use or disclose any government related identifiers unless required or we are authorised by law, such as if necessary to verify your identity for Anti-Money Laundering and Counter-Terrorism Financing purposes. 

2.3 Disclosure of personal information

We may disclose your personal information outside of LSN Capital:

  • as required by relevant laws, such as those relating to Anti-Money Laundering and Counter Terrorism Financing,

  • to contractors, service providers, including internet service providers, cloud hosting service providers, software suppliers, maintenance and support service providers, and security services on a confidential basis so that they can provide services to us;

  • to counterparties who issue, provide or facilitate products and/or services that you instruct us to acquire or invest in,

  • other parties involved in providing, managing or administering your financial products and services,

  • to our external consultants such as legal, compliance, accounting, insurance, and tax; and

  • to your nominated financial adviser or an authorised person with your consent.

3. How personal information is stored

Your personal information will be stored in a secure environment either electronically and/or in hard copy. We use security procedures and technology to protect the information we hold, and take reasonable steps to ensure your personal information is protected from misuse and loss from unauthorised access, modification or disclosure. 

Only authorised personnel are granted direct access to your information, on a need-to-know basis in order to perform their obligations and duties. 

Where the personal information we collect is no longer required, we either delete the information or permanently de-identify it. 

4. Breach

We implement corrective plans if our security measures are breached, your personal information is lost or inadvertently accessed by an unauthorised person. You will be advised if we assess the breach is likely to cause you serious harm, within 30 days of the breach event.

5. Seeking access to and updating information we hold about you

You have the right to request access to your personal information that we hold about you and to request that a correction be made to our records if the information recorded about you is inaccurate. If we cannot meet your request to make a correction, we will notify you by email.
